You are only entitled for flight cancellation compensation under EU 261 compensation laws if:

  • You were notified of the flight cancellation less than 14 days before it was scheduled to depart.

When am I not entitled to compensation for a flight that has been cancelled?

The EU Regulation also specifies the circumstances in which you are not entitled to compensation if your flight is cancelled. Under EU legislation, a traveller who misses a flight is not entitled to compensation if:

  • The flight was cancelled due to extraordinary circumstances (adverse weather conditions, air traffic control strikes, airport staff strikes, civil unrest, terrorism, and others).

  • 14 days before travel, the airline notified passengers of any cancellations.

  • The passenger received a discounted airline ticket (not available to the general public) or was given a free flight ticket (ex., pilots and hostesses travel free of charge)

What rights do I have if my flight is cancelled?

You have different EU cancellation rights under Regulation 261/2004.

In most circumstances, you may be entitled to compensation. If the airline notifies you of the cancellation less than 14 days before the departure date, you may be eligible for compensation.

Regardless of when you receive your cancellation notification, you have the option to do one of the following:

  • Full flight ticket refund and (if necessary) return flights to the original point of departure,

  • or substitute flight to your final destination (the earliest possible or at a later date)

If a flight is cancelled while in the airport, the airline must also:

  • notify you of the cancellation as well as your rights to assistance and compensation (in writing at the check-in desk), and if.

  • two free phone calls, emails, or faxes, as well as complimentary meals and refreshments while waiting in the airport.

  • If an overnight stay is required, they should provide you with a complimentary hotel room and transportation.

The airline cannot demand additional payment if your new alternative flight was upgraded to a higher class. You are entitled to a refund of between 30-70 percent of the original ticket price if it was downgraded to a lower class.
